Preliminary Article – Definitions :
“The Tourist Office”: refers to EPIC Courchevel Tourisme.
“The Customer”: refers to the person placing orders for services with Courchevel Tourisme.
“The Services”: refers to all services offered by EPIC Courchevel Tourisme.
“The Service Providers”: refers to the professionals delivering the Service.
“The Website”: refers to the website www.courchevel.com.
Article 1 - Application and Enforceability of the General Terms and Conditions of Sale :
These General Terms and Conditions of Sale apply to all sales made through the online store of EPIC Courchevel Tourisme via its website.
Consequently, unless otherwise agreed, placing an order implies the Customer's full and unreserved acceptance of these general terms and conditions of sale - hereinafter referred to as the General Terms and Conditions of Sale - to the exclusion of all other documents such as prospectuses, catalogs, brochures, or other documents of any kind issued by the Tourist Office, which are for information purposes only.
No special conditions may prevail over the General Terms and Conditions of Sale unless formally accepted in writing by the Tourist Office. Any contrary condition put forward by the Customer shall therefore be unenforceable against the Tourist Office, unless expressly accepted by the latter, regardless of when it may have been brought to its attention.
EPIC Courchevel Tourisme acts solely as a booking center through online sales on its website.
Article 2 – Formation of the contract
2.1. Reservation :
The order for Services may only be contracted by Customers after they have read and formally accepted the terms of the General Terms and Conditions of Sale in their entirety.
Before placing any order, the Customer must accept these General Terms and Conditions of Sale by checking the box or clicking on the hyperlink provided for this purpose on the Website.
The Customer declares and acknowledges that they have full knowledge of these General Terms and Conditions of Sale and accepts them.
No order can be finalized without the Customer's express acceptance of these General Terms and Conditions of Sale.
To place an order, the Customer must be legally capable of entering into a contract under French law.
All reservations are firm and final, except in the case of exercising the right of withdrawal provided for in Article 6, or modification/cancellation under the conditions provided for in Articles 7 & 8 of these General Terms and Conditions of Sale.
In the event of an online booking made by the customer more than 30 (thirty) days prior to the start date of the service, a non-refundable deposit of 50% of the total amount including tax will be definitively collected. Thirty days prior to the start date of the service, the remaining 50% will be definitively collected and retained by Courchevel Tourisme.
In the event of an online booking made by the customer less than 30 (thirty) days before the start date of the service, the total amount including tax for this service will be collected in full and is definitively acquired by Courchevel Tourisme.
In both cases, cancellation insurance will be offered to the customer to cover the risk of cancellation of their stay in accordance with the terms and conditions set out in Article 9 “Cancellation Insurance”.
Reservations for Services offered by the Tourist Office can be made via the website www.courchevel.com.
2.2. Specific features of online booking
All information provided by the Tourist Office concerning the Services offered, appearing either on the website or in documents issued by the latter, is purely informative, it being specified that this information varies depending on the Service Providers concerned.
This information is constantly updated, but it is recommended that the Customer contact the Service Provider directly to obtain information from them.
The Tourist Office is available to provide the Customer with any additional information about these Services.
Confirmation of the General Terms and Conditions of Sale implies the Customer's implicit acknowledgment that they have obtained all the information they require about the nature and characteristics of the Services.
A printed version of the General Terms and Conditions of Sale and any information sent electronically will be admissible in any legal proceedings concerning the application of these General Terms and Conditions of Sale in the same way and under the same conditions as any other document written and kept in paper format.
The sale becomes firm and final upon validation by the Customer of the summary of the Services ordered and payment of the full price of the Services ordered.
Until these conditions are met, the Sale shall not be considered final and the Tourist Office shall not be required to provide the Services ordered.
Once the Sale is final, it may not be modified or canceled by the Customer, subject to the provisions of Articles 6, 7, and 8.
2.3. Confirmation of the reservation
A reservation file with the status: “Reservation confirmed” is issued by Courchevel Tourisme with the exact amount invoiced, the content of the Services ordered, the General Terms and Conditions of Sale, the terms and conditions for exercising the right of withdrawal, and the address to which complaints can be sent. This confirmation constitutes acceptance of the order and validates the transaction. The Customer accepts that the order registration systems constitute proof of purchase and date.
Article 3 - Conditions for the provision of Services
3.1. General provisions
The duration of each Service is that stipulated by the Tourist Office.
With regard to accommodation reservations, the Customer may not, under any circumstances, claim any right to remain in the premises at the end of the Service.
For the proper performance of certain Services, the Customer must arrive on the specified day at the specified times or contact the Service Provider directly.
3.2. Special provisions depending on the Services ordered
3.2.1. Services consisting solely of accommodation
When booking accommodation, the Customer is advised to notify the Service Provider directly of their arrival time. The Customer must refer to the opening hours of the establishment booked.
In the event that the room(s) reserved are no longer available upon the Customer's arrival, the Service Provider must, at no additional cost to the Customer, provide one or more rooms equivalent to the reservation, in another establishment of equal or superior class, at a price equal to or lower than the price of the room(s) reserved.
3.2.2. Tourist products and tourist packages :
The times indicated must be respected in order to ensure the smooth running of the Service.
In the event of a significant delay on the part of the Customer, the Service Provider shall be free not to perform the Service; in this case, the Customer shall be solely responsible for their delay and shall be invoiced for the full price of the Service.
In the event of a change to the activities offered by the Service Providers, the Tourist Office shall in no way be liable for any obligation to achieve a specific result or for any compensation to the Customer.
The same applies in the event of cancellation of the Services, in particular for climatic reasons, in cases of force majeure, or when the number of participants required for the activity to take place is not reached.
In the event of cancellation by the Service Provider, when the Service Provider cancels one of its Services before the start of the Service, the Service Provider or the Tourist Office must inform the Customer by any means. The customer, without prejudice to any claims for compensation for any damages suffered, will be reimbursed without penalty for the sums paid.
Article 4 – Prices
Unless otherwise stated on the Website, the prices listed on the Website are displayed in Euros, including VAT.
Any Services not included in the package must be paid for on site.
The Customer's attention is drawn to the fact that additional local taxes payable on site may be imposed by the local authorities (tourist tax, visitor's tax, etc.) and are payable by the Customer. The Tourist Office reserves the right to modify the price of its Services at any time in agreement with the Service Provider.
Payment for the Services ordered is made by direct debit at the time of booking on the website via a secure payment system.
In any event, additional local taxes such as tourist tax are to be paid directly to the Service Provider on arrival or departure, according to the establishment's own terms and conditions.
Article 5 – Supporting documents
Upon final confirmation of the order under the conditions indicated in Article 2, the Tourist Office undertakes to send the Customer booking confirmations relating to the order for products, tourist services, etc.
Article 6 - Right of withdrawal
Depending on the type of service ordered, the Customer may or may not have a right of withdrawal.
The Customer's attention is drawn to the fact that there is no right of withdrawal for Customers who order accommodation, transport, or catering services, pursuant to the combined application of Articles L121-20-4 para. 2 and L121-18 of the French Consumer Code.
For all other types of services, it is reminded that in accordance with the provisions of Article L.121-20 of the Consumer Code, the Customer has a period of 7 clear days from the date of order confirmation to exercise their right of withdrawal, by letter or email addressed to the Tourist Office :

It is specified that reservations made by the Customer via the online sales section of the website www.courchevel.com are firm and final.
In any event :
- no request for modification by the Customer may be made less than one week before the scheduled start date of the Service with regard to dry accommodation;
- no changes may be made by the Customer with regard to guided tours/concerts/shows/excursions;
- no requests for changes may be made by the Customer with regard to packages and/or tourist packages less than one week before the start of the Service.
Customers who wish to cancel one or more Services are therefore advised to read the terms and conditions for canceling or modifying a reservation.
Article 8 – Cancellation by the Customer
Any total or partial cancellation must be made via the online sales site by logging into the personal booking file or must be notified by contacting the Tourist Office directly by telephone on +33 (0)4 79 08 00 29, confirmed by letter or e-mail addressed to the Tourist Office :

8.1. For reservations concerning Services that only include accommodation :
In the event of total or partial cancellation by the Customer, without the service provider being able to modify its reservation schedule, no refund will be made.
If the Customer does not show up at the place of accommodation, no refund will be made.
8.2. For reservations for guided tours, tickets, ski lift passes, products, and tourist services:
For admission to tourist sites and ski lift passes, tickets are valid for the reservation date indicated on the tickets. They are non-exchangeable and non-refundable.
For guided tours/concerts/shows/excursions, tickets cannot be returned or exchanged, except in the event of cancellation of the event.
8.3. Special pricing :
The Customer's attention is drawn to the fact that certain Services booked through the Tourist Office that benefit from special pricing (promotions, special rates) cannot be modified or canceled.
Article 9 – Cancellation insurance :
When confirming their booking, customers have the option of taking out cancellation insurance, the terms and conditions of which are detailed via a link accessible in the booking basket.
Article 10 – Changes made by the Tourist Office :
If, prior to the scheduled start date of the Service, the Tourist Office is forced to make a change to one of the essential elements of the contract, the Customer may, after being informed by the Tourist Office by any means:
- Either terminate their contract and obtain, without penalty, an immediate refund of the sums paid;
- Or accept the modification or substitution of Services proposed by the Tourist Office, in which case an amendment to the contract specifying the modifications made shall be signed by the parties;
- If the substitute Service is less expensive than the Service ordered, the excess amount paid shall be refunded to the Customer before the start of the Service;
- In the opposite case, the Customer shall pay the difference.
Article 11 :
- Force majeure A case of Force Majeure as defined below shall suspend the obligations hereunder from the moment it occurs.
The following are contractually considered cases of Force Majeure leading to the suspension of the Contract and exemption from liability, if they occur after the conclusion of the Contract and prevent its execution: labor disputes on a national scale, fire, explosions, mobilization, requisitioning, embargoes, insurrections, general lack of means of transport, general lack of supply of raw materials, and restrictions on the use of energy.
The Service Provider reserves the right to cancel any reservation in the event of force majeure and to change the date. If the Service Provider is obliged to cancel the Service before the Customer has been able to start the activity, a postponement of the activity will be offered.
Article 12 - Personal data
12.1. Right to and protection of personal data
The website www.courchevel.com has been declared to the CNIL (French Data Protection Authority).
The personal information provided by the Customer on the Website, including the credit card number, name, and address, is used to process and fulfill orders and is encrypted using encryption software to prevent it from being read when transmitted over the Internet.
In accordance with Article 32 of the French Data Protection Act of January 6, 1978, amended by Law 2004-801 of August 6, 2004, the information required to process and fulfill orders is marked with an asterisk on the pages of the Website.
Other requests for information requiring an optional response from the Customer are justified by the desire to learn more about the Customer and to improve the services offered to them.
12.2. Communication and modification of personal data
The databases on the online sales site are intended exclusively for use by the Courchevel Tourist Office. Under no circumstances may they be sold or transferred to a third party, with the exception of transfer to the service provider(s) of the customer file.
The Customer has the right to access, modify, rectify, and delete data concerning them. To exercise this right, they simply need to contact the Tourist Office.
Article 13 – Liability
The Tourist Office cannot be held liable for the total or partial non-performance of the Services ordered or for the total or partial non-compliance with the obligations stipulated in these General Terms and Conditions of Sale in the event of unforeseeable circumstances, force majeure, poor performance, faults committed by the Customer, or unforeseeable and insurmountable events caused by a third party not involved in the provision of the Services.
Similarly, the Tourist Office is not responsible for the performance of the Services by its Partners.
Article 14 - Disputes / Complaints
Any complaint relating to a Service must be sent by registered letter with acknowledgment of receipt to the Tourist Office within 10 days of the date on which the Service was provided, to the following address:

Failing this, no complaint will be accepted by the Tourist Office.
The General Terms and Conditions of Sale are subject to French law.
Any dispute relating to their interpretation and/or execution shall be brought before the French courts.
The Customer acknowledges having read and accepted these General Terms and Conditions of Sale.
Article 15 - General provisions
The Tourist Office has taken out travel organizer civil liability insurance with the insurance company ALLIANZ IARD – 87 rue de Richelieu – 75002 PARIS – FRANCE. The policy number is 44034858 and provides financial coverage of €30,490.00 (thirty thousand four hundred and ninety euros) with BANQUE DE SAVOIE – 6 boulevard du Théatre – BP 30109 – 73001 CHAMBERY - FRANCE, in order to cover the consequences of professional civil liability that it may incur in its capacity as a local tourism organization authorized to market products.
The fact that the Tourist Office does not invoke one of the provisions of the General Terms and Conditions of Sale at a given time shall not be interpreted as a waiver of its right to invoke one of these provisions at a later date.
In the event that any provision of the General Terms and Conditions of Sale is declared null and void or ineffective, that provision shall be deemed unwritten, without affecting the validity of the other provisions, unless the provision declared null and void or ineffective was essential and decisive.
The fact that the Tourist Office does not invoke any of these General Terms and Conditions of Sale at a given time shall not be interpreted as a waiver of its right to invoke any of these conditions at a later date.
Except in cases of fraud, for which the Customer is responsible for providing proof, the Customer is financially responsible for their actions on the Website, in particular for the use made of their Customer name and password. They also guarantee the truthfulness and accuracy of the information concerning them provided on the Website.
Any use of the Website that is fraudulent or deemed to be fraudulent, or that contravenes these General Terms and Conditions of Sale, will justify the refusal of access to the Services offered by the Partners or other features of the Website at any time.
The specific terms and conditions of the Partners indicated in the description of the Service and on the booking confirmation also apply to the offer and provision of Services, under the same terms and conditions as these General Terms and Conditions of Sale.
The act of purchasing and/or booking implies acceptance of the specific terms and conditions of the partners.
